Terms and Conditions of Participation "ContiGuarantee"

In this document, you will find a complete overview of the official and binding Commercial Vehicle Rules and Terms and Conditions for the use of the Continental damage guarantee program (hereinafter referred to as "ContiGuarantee"). Any variations to these Terms and Conditions can only be made in writing and can only bind us if signed by an authorised officer of Continental.

We generally distinguish between a statutory warranty and a voluntary warranty for Continental products. The legal warranty is part of every purchase process and applies to damage caused by production defects that occur after purchase. Your statutory rights in respect of the Tyres such as warranty rights or product liability rights in the event of defects remain unaffected. The ContiGuarantee is additional to those rights.

ContiGuarantee is provided to you at no additional cost as a free benefit against accidental damage for commercial vehicle tyres in inch sizes 19.5 to 22.5 of the Continental CrossTrac brand (the “Tyres”), which must be registered after purchase by the participant. 

The DOT number (format WWYY) which appears on the sidewall of the tyre must show to be within four years of the manufacture at the time of the claim; for example, a tyre manufactured in the first week of 2022 with a DOT code of 0122 would be within 4 years of manufacture up to the first week of 2026. The DOT code can be found on the sidewall of the tyre - look for the letters ‘DOT’, followed by four digits in a box. The first two numbers are the week of manufacture, with the second representing the year of manufacture If there are any queries relating to DOT numbers, please consult with Continental Technical Services team.

The administrator and provider of ContiGuarantee 

Continental Tyre Group Limited, a legal entity registered in England with company number 00296602, with its registered office at Botanica Ditton Park, Riding Court Road, Datchet, Slough, SL3 9LL is the administrator and provider of ContiGuarantee (hereinafter referred to as the "Provider" or "Continental").

Duration of ContiGuarantee

Continental may amend the terms of the ContiGuarantee at any time (with those changes taking effect from then on) or discontinue it at any time. In the event you have already registered for the ContiGuarantee, the ContiGuarantee will continue to apply for the specific Tyres that were valid at the time of registration. 

 Validity of ContiGuarantee

The ContiGuarantee is only available in the UK and Ireland. This voluntary warranty covers tyres that are properly purchased by participants at a trade / dealership or through directly from Continental Tyres UK on  www.contionlinecontact.com The warranty is offered exclusively through the website - www.continental-tyres.co.uk/continental-for-business/Conti-Guarantee. The framework conditions described below refer to these tyres, i.e. tyres that were purchased in the UK or Ireland.

General conditions of the voluntary warranty for Continental commercial vehicle tyres in inch sizes 19.5 to 22.5: 

In order to participate in the ContiGuarantee and program, the participant must register on the website. To be eligible for the ContiGuarantee, the participant must upload a copy of the proof of purchase to the website this must be in the form of a receipt or invoice from their supplier without however showing the purchase price  Participant data relating to the tyres purchased and their contact information must also be provided to enable processing of the claim. 

Tyres are covered by this guarantee until half-worn, in compliance with the original tread depths of rubber stipulated as follows:  These include equal to or greater than 90% of the overall tread depth = credit note of 100% of the *reference price.  Less than 90% but no less than 50% of the overall tread depth = credit note of 75% of the reference price.  Less than 50% of the overall tread depth = no credit note applicable.  See reimbursement list available on the ContiGuarantee Digital Guide, available in the Find out more section of this page.  

*The reference price is selected from a pre-determined list supplied by Continental.  The tyre price is calculated per article and is based on an average dealer price + their assumed margin + remaining tread depth (as detailed in the digital guide).

ContiGuarantee is valid for all new Continental commercial vehicle tyres in the CrossTrac construction tyre product line, in 19.5” to 22.5” inch sizes.  The promotion does not apply to ContiLifeCycle products ContiRe and ContiTread.  

Voluntary Accidental Damage Guarantee

In the event of the terms of the accidental damage guarantee being met, the participant will receive a refund by bank transfer by an external service provider on behalf of Continental. For this purpose, the participant must provide the external service provider with their business bank details (IBAN and BIC). The amount of the refund will be determined based on the current tyre price as calculated by Continental at the start of the programme. Subsequent possible additional refunds, due to any price changes that may have taken place in the meantime, cannot be taken into account.

The tyre price should not be shown on the proof of purchase - therefore, a price based on the market price at the date of purchase will be determined - this is calculated per article and is based on an average dealer price + their assumed margin + remaining tread depth (as detailed above).  Other items, such as balancing, incurred downtime and other tyre-related costs, will not be reimbursed.

Warranty claims by ContiGuarantee can only be asserted if: 

a)       if the tyres have been registered by the participant via the website.  The participant must be the end user of the tyres and not a tyre dealer / service provider acting on the participant’s behalf. 

b)       if the tyres have been registered with the serial number of each individual tyre within 14 days from the date of purchase of the tyres. 

c)       the tyres are sold within 4 years of manufacture (please refer to DOT code)

d)       if irreparable damage occurs, which does not result from an unrelated use, and which was caused during the standard operation of the vehicle - these include:

1.       Sidewall and collision damage caused by external influences, e.g. curbs or tread injuries, cuts or damage caused by an impact.

2.       irreparable punctures of the tyre that have a larger circumference, e.g. through nails, screws or glass. 

3.       in the event of vandalism damage with police documentation.

4.       if the participant is the original buyer. Participation in ContiGuarantee is non-transferable.

5.       if the tyre lines defined under point 3 are concerned.

6.       if the 12-month accidental damage extended warranty has not expired for Continental commercial vehicle tyres from registration.

e)       Warranty claims cannot be claimed if:

1.       if tyre damage occurs which deviates from the conditions set out in point “d” above.

2.       for towing to the nearest service centre, repair or replacement of tyres or spare tyres, etc., or to offset these costs.

3.       for tyres for which the origin cannot be proven (e.g. missing serial number or DOT) or for which the nature of the damage cannot be proven during the warranty inspection, as well as for incomplete tyres. 

4.       for tyres damaged by natural disasters and fires or for stolen tyres.

5.       for incorrectly repaired tyres or incorrectly regrooved tyres. 

6.       if there are defects in the manufacture of tyres (which fall under the standard procedure for warranty claims required by law). Then the standard process for a warranty on the part of Continental Tyres UK applies. 

7.       in the event of issues created by poor tyre maintenance including uneven wear, misalignment issues, underinflation or misuse due to mechanical failure of the vehicle or poor technical condition of the vehicle, wear due to the effects of chassis parts (shock absorbers, geometry), operation with inappropriate tyre pressure or due to use with an overloaded vehicle. 

8.       in the event of improper installation or disassembly of the tyre, which includes the use of non-approved rims.

9.       for tyres used in competitions or other events that were not used for the originally intended use. For example, for tyres that have been used in a clearly incorrect application. 

10.   for tyre damage caused intentionally or through gross negligence by the participant*.

*Continental also reserves the right to request to visually inspect the tyre as part of the claim process should there be need to verify the tread depth remaining or condition of the tyre.  The return of the tyre should be arranged by the end user via their nominated tyre service provider and all subsequent costs of this are met by the customer. 

Conditions for participation in ContiGuarantee

Participants in this program must be the end user of the tyres and not a tyre dealer / service provider acting on the participant’s' behalf.   This can be any end user / customer who has their registered office or branch in the UK and Northern and Southern Ireland. The program is not open to people involved in the organisational relationship, i.e. people who influence the course of ContiGuarantee, who are organisers of ContiGuarantee, as well as people who are directly connected to these people, their siblings and their husband or wife and other close persons. If an excluded person tries to register for the ContiGuarantee despite the above information, the guarantee/refund may be refused.

Participation in ContiGuarantee 

The participant becomes a user of ContiGuarantee:

a)       at the moment they register on the website. The participant will be informed about the successful registration as well as the registration of the tyres by e-mail.

b)       To register with ContiGuarantee, Commercial customers (Participants in this program must be the end user of the tyres and not a tyre dealer / service provider acting on the customers' behalf.) must fill out various mandatory fields including:

1.       first and last name

2.       Company address (by registered office): street, postcode, city

3.       e-mail address of the contact person

4.       Responsible Continental Account Manager

5.       tyre size (s)

6.       tread pattern

7.       The serial number of each tyre individual tyre registered

8.       Upload the tyre invoice / proof of purchase, excluding the purchase price where possible, and including the date and tyre product line. 

c)       On submission of a claim a mandatory upload of at least 3 photos including the following requirements is required including:

1.       The specific tyre damage: this photo should include the area(s) where the tyre damage has occurred specifically and have the damaged areas as a central point in the photograph.

2.       The Tyre Serial Number: the full serial number must be shown to verify the product corresponds with your list of registered tyres.

3.       The tread depth remaining: the tread depth must be measured by using a suitable gauge designed for commercial use which can measure the tread grooves reliably and is free from any damage.  The gauge must have contact on both ribs to enable an accurate reading, and the reading must reflect the lowest point on the tyre.  In the supporting information field, the remaining tread depth in millimetres should also be typed in.

4.       There is also a mandatory description free text field where the customer should add supporting comments describing the damage and including the tread depth remaining in (mm)

5.       General good practise when taking supporting photographs: Please ensure there is sufficient light and focus to enable us to review the damage and tyre details submitted.  The photos should all be taken at the same time and place, and in a safe location. 

d)       Failure to adhere to these requirements may result in additional photographs being requested and a delay in your claim. Continental also reserves the right to request to visually inspect the tyre as part of the claim process should there be need to verify the tread depth remaining or condition of the tyre. 

e)       In the event of acceptance of the guarantee, the participant will receive the reimbursement funds by bank transfer. For this purpose, the participant must provide the SERVICE PROVIDER with his business bank details (IBAN and BIC). 

f)         If the participant has agreed by accepting the terms and conditions of ContiGuarantee, the user account will be created on the website. At the same time, the participant consents to the processing of personal data. Continental’s full privacy policy can be found here: https://www.continental-tyres.co.uk/legal-pages/data-protection/.

g)       The registration data is used to uniquely identify the purchaser of the tyres and at the same time can be checked and managed by the participant on this website. 

h)       After registration, the Participant is entitled to provide a warranty (in accordance with these Rules of Procedure and Application) for damaged tyres for a maximum period of 12 months from the date of purchase of the tyre. 

i)         The principle of the warranty is to provide compensation to the participant for damaged tyres that have been duly purchased and subsequently registered on the website and that meet all the conditions set out in these ContiGuarantee regulations. The Supplier undertakes to pay the residual value of the specified Continental brand tyres (in accordance with point 4). 

j)         The warranty can be claimed within 30 days from the date of the puncture or damage, but no later than 1 years from the date of purchase of the tyre. The participant can contact the service provider commissioned by Continental to handle the transaction via the website. In order for the claim to be assessed, the participant must take photos of the damaged tyres and upload them to the website. 

k)       As part of the warranty rules, the participant must provide an uploaded invoice for each warranty claim. This data was already requested during registration. 

l)         The request for a claim will be processed within 30 days from the time of the claim. 

m)     The participant will be informed when the warranty claim has been reviewed In the event of a claim, the participant will receive a refund by bank transfer by an external service provider on behalf of Continental. For this purpose, the participant must provide the external service provider with their business bank details (IBAN and BIC). The participant can check the status of the warranty claim in their account login on the website. 

n)       In the event of a refusal of the warranty claim, the participant will be informed by e-mail, including the reason for the refusal.

Additional ContiGuarantee Terms and Conditions

Each participant can register an unlimited number of tyres that meet the conditions of ContiGuarantee and unless otherwise regulated.

Each participant can claim a maximum of 24 tyres per year. 

The participant is not entitled to request any other refund in lieu of the refund and cannot claim more than he or she has been awarded. Proof of this is the invoice data provided. The Provider is not obliged to the Participants of ContiGuarantee in any other way and the Participant is not entitled to any refund other than those specified in these Rules. The provider is not responsible for the services of third parties.

The Provider is not responsible for the technical equipment of the Participant and other persons in connection with participation in ContiGuarantee or the downloading of material related to ContiGuarantee participation, as well as for any other technical telecommunication difficulties or defects that occur during the Program, for the speed of the technical connection or other possible defects that may arise in connection with ContiGuarantee or in connection with electronic communications networks, mobile operators or their availability to subscribers, or for damage to and from damage caused by computers.

The participant cannot claim any guarantee other than that granted to them. The guarantee cannot be paid out in any other form of payment, except for the form mentioned.

The participant is only allowed to be reimbursed for only one warranty or guarantee request out of all guarantee/support services offered by the provider. For example, for a registered tyre, either a warranty claim in accordance with ContiGuarantee or a warranty claim on the basis of statutory standard warranty claims (or possibly other similar services provided by Continental) can be asserted. This means that double reimbursement of costs is not possible.

The provider makes a final decision on complaints or other objections, and the decision made is final.

The Provider is not liable for damages that the participant does not incur in connection with participation in ContiGuarantee or in connection with the use of warranty claims. For example, no claim can be made for damage to the vehicle.

The Provider reserves the right to require any registered participant at any time to submit any document relevant to ContiGuarantee and its application or the registered Continental tyre in order to verify the right to participate in ContiGuarantee, in particular in the event of suspected unfair conduct, even if the participant has not yet exercised his right to warranty. 

Continental reserves the right to exclude participants from ContiGuarantee if Continental has a justified suspicion of fraudulent or unfair behaviour, including towards third parties.

The Provider reserves the right not to issue a refund if there are doubts about the manner in which the ContiGuarantee Guarantee will be claimed, or if the Participants violate the Program Rules, or if the Participants take actions that violate the principles of morality or fair gaming. 

Continental also reserves the right to request to visually inspect the tyre as part of the claim process should there be need to verify the tread depth remaining or condition of the tyre.  The return of the tyre should be arranged by the end user via their nominated tyre service provider and all subsequent costs of this are met by the customer.   

The Provider reserves the right to change the ContiGuarantee Program Duration, to postpone, interrupt or terminate the ContiGuarantee Program or to unilaterally change or supplement its rules for the entire ContiGuarantee Program Duration without prior notice and without compensation by announcing the change on the website, provided that valid and complete rules are always available.

The Provider's right to terminate the ContiGuarantee program applies primarily (but not exclusively) to cases in which it is not possible to proceed according to plan for any reason, such as force majeure or due to a malfunction in the information technology necessary for the event, or for other technical, organisational, financial or legal reasons that may be necessary for the administration, security, integrity and the normal and orderly operation of the ContiGuarantee Program, and/or if the ContiGuarantee Program cannot be continued due to computer falsification. This includes fraud, manipulation, technical failure, or other reasons beyond the control of the Provider that disrupt or jeopardize the security of the Administration, fairness, integrity, and the proper functioning of the Program.

The ContiGuarantee provider is entitled to verify the fulfilment of all conditions for participation in the Program and, in the event of a dispute, to make a final decision on all issues related to ContiGuarantee. The Provider has the right to exclude any Participant from the Program if this Participant violates the Rules, without the Participant being entitled to compensation for any costs or damages that the Participant may subsequently incur.

The full terms and conditions are always available on the website. The Rules of Procedure may be communicated in abridged form via promotional material related to ContiGuarantee, but these complete rules shall be deemed to be the only, complete, final and binding rules within the ContiGuarantee Program. Even if these persons meet certain requirements for receiving a guarantee, e.g. due to false information, they are not entitled to the ContiGuarantee service. The participant will be excluded if the provider has reasonable suspicions of fraud or unfair behaviour. This also applies to cases where the participant wants to exploit the ContiGuarantee service through third parties or violates fair play. The law of England and Wales is applicable. The place of jurisdiction for all disputes is the English Courts.
