Conditions of participation for the promotion ContiChallenge

2. Participation conditions
2.1 Participation in the promotion is performed by a one-time registration, filling out the registration formby 31.12.2023. Participation is free of charge.
2.2 All legal entities working in the tire business are eligible to participate. Participants must provide their company name as well as their e-mail address upon registration. Participation under a false name or in the name of another business or person is not permitted. Multiple participation in the promotion (even under different names) is not possible.

2.3 Employees of Continental or an employee of Continental affiliate within the meaning of §§ 15 ff. German Stock Corporation Act and their relatives as well as other persons involved in the design and implementation of this competition are excluded from participation.

 

3 Duration and prize(s) of promotion
3.1 Participation in the promotion is possible until 31.12.2023 at 24:00 o’clock.
3.2 The participants will be determined after the registration but no earlier than the tire failures.
3.3 The refund is defined as:
Definition the difference: If the Continental tires do not offer the lowest cost of ownership, multiply the difference per operating hour by the number of hours realized by the Continental tires.
Cash payment of the refund is excluded.
3.4 The participant is solely responsible for any taxation of the refund.
3.5 Continental reserves the right to terminate the promotion prematurely or extend it in time without prior notice and without giving reasons. This applies in particular, if a proper execution cannot be guaranteed for technical or legal reasons. In such a case the participants are not entitled to any claims against Continental.

 

4 Promotion details
4.1 Participants must purchase a complete axle set of Continental OTR tires.
4.2 Comparable tire from competitor brand must be of equivalent tire construction and technical design, and
4.3 must be at the same location under the same operating conditions to the competitor (e.g. vehicle, tire setup, application)
4.4 Offer limited to maximum (one) complete vehicle set of Continental OTR tires for a maximum of two vehicles. Installation and removal of the trial sets of Continental tires and trial set of competitive tires must be monitored, and operating hours documented by an authorized Continental tire dealer.
4.5 Continental representative or authorized dealer will be responsible for determining “same operating
conditions”.

 

5 Exclusion from participation
Continental reserves the right, at its own discretion, to exclude companies from participation in the competition, to confiscate and reclaim refunds if there is reasonable suspicion of misstatements, manipulation, violation of these conditions of participation or other unauthorized actions.

6 Disclaimer of liability
The participant hereby acknowledges that Continental do not guarantee or warrants the availability of the websites through which the participation in the competition takes place or the content posted on them. Continental reserves the right to restrict the availability of these websites (even without prior notice) or to restrict access to them in whole or in part. Continental is not liable for the insolvency of the cooperation partners and the resulting consequences for the performance of the competition and the processing of the prize. Continental, its organs, employees or vicarious agents shall not be liable for any damage that may arise as a result of errors, delays or interruptions in transmission, malfunctions of technical equipment or a service, incorrect content, loss or deletion of data, viruses or in any other way in connection with participation in the competition, unless such damage is caused intentionally or through gross negligence on the part of Continental. This exclusion of liability does not apply to injuries to body, life and health.

 

7 Data Protection
Continental may store personal data of the participants for the participation of the promotion insofar as such storage and transmission is necessary for the execution of the promotion. After the end of the promotion, data will be deleted in accordance with the legal regulations. The information provided in this promotion will be used only for the purpose of processing the promotion, unless expressly confirmed otherwise by the participant, and will not be passed on to third parties without the express permission of the participant. 8 Additional
8.1 Legal recourse is excluded.
8.2 These conditions of participation and the entire legal relationship between the participants and Continental are subject exclusively to the law of Germany.
8.3 Should a provision of these conditions of participation be or become invalid in whole or in part, the validity of the remaining provisions of these conditions of participation shall not be affected. In place of the invalid provision, the legally permissible provision that comes closest to the meaning and purpose expressed in the invalid provision in economic terms shall apply. The same applies in the event that these conditions of participation contain an unintentional gap of regulation.
8.4 Place of performance and jurisdiction is Germany, insofar as an agreement on this is permissible. If the participant does not have a general place of jurisdiction in Germany or moves his or her place of residence abroad after participation, the registered office of Continental is also agreed as the place of jurisdiction.
